User Agreement for Mploy Jobs Platform

The Mploy Jobs Platform (including any mobile applications, websites, and web applications) is provided by Shasta Recruitment Technologies ("Mploy Jobs"). Through the Mploy Jobs Platform, any person with a verified account can post jobs ("Job Poster") and access services provided by Mploy Jobs. By using the Mploy Jobs Platform, you consent to the terms of the User Agreement, in addition to our Privacy Policy.

A Job Poster accessing the Mploy Jobs Platform shall be bound by this User Agreement, and all other rules, regulations, and terms of use provided by Mploy Jobs in relation to any services provided via the Mploy Jobs Platform ("Mploy Jobs Services").

Mploy Jobs reserves the right to modify this User Agreement, rules, regulations, and terms of use at any time by posting them on the Mploy Jobs Platform. Use of the Mploy Jobs Platform constitutes the Job Poster's acceptance of such modified terms. Mploy Jobs may also notify the Job Poster of any change or modification by sending an email to the Job Poster's registered email address or posting notifications in the Job Poster accounts. Failure to indicate non-acceptance within the specified time frame implies acceptance of the modified terms.

Certain Mploy Jobs Services may be subject to additional rules and regulations. To the extent that this User Agreement is inconsistent with additional conditions, the additional conditions shall prevail. Mploy Jobs may, at its discretion:

- Restrict, suspend, or terminate any Job Poster's access to all or any part of the Mploy Jobs Platform or Mploy Jobs Services.

- Change, suspend, or discontinue all or any part of the Mploy Jobs Platform or Mploy Jobs Services.

- Reject, move, or remove any material submitted by a Job Poster.

- Deactivate or delete a Job Poster's account and all related information and files.

- Establish general practices and limits concerning use of the Mploy Jobs Platform.

- Assign its rights and liabilities to all Job Poster accounts to any entity (post such assignment, intimation shall be sent to all Job Posters to their registered email ids).

If Mploy Jobs charges Job Posters a platform fee for any Mploy Jobs Services, Mploy Jobs shall repay such platform fee in the event of suspension or removal of the Job Poster's account or Mploy Jobs Services due to negligence or deficiency on the part of Mploy Jobs, except if such suspension or removal is due to:

- Breach or inadequate performance by the Job Poster of this User Agreement.

- Circumstances beyond the reasonable control of Mploy Jobs.

By accepting this User Agreement, Job Posters consent to receiving communications such as announcements, administrative messages, and advertisements from Mploy Jobs or any of its partners, licensors, or associates.



2.Participation

When using the Mploy Jobs Platform and Services, Job Posters can post jobs to recruit candidates, view suitable candidate profiles, and schedule interviews.

To post a job, Job Posters must provide job details such as role, part-time or full-time status, work days and timings, salary range, number of openings, minimum education level, and required experience. While Mploy Jobs prohibits discrimination, Job Posters can specify if a job is gender-specific.

Job Posters must ensure job information is accurate, not misleading, and free from discrimination. Mploy Jobs reserves the right to remove job postings or suspend accounts for incorrect information.

Candidate applications on the platform remain active for 60 days. After this period, applications are archived, and Job Posters lose access. Candidates can reapply after 60 days if the job is still active.

Job Posters must adhere to the Code of Conduct when posting jobs and using Mploy Jobs Services.



3. Intellectual Property

The intellectual property rights in all software, materials, and content on the Mploy Jobs Platform, including software, advertisements, written, audio, and visual content, are owned by Mploy Jobs, its affiliates, partners, licensors, and/or associates. Job Posters may not modify, reproduce, or distribute any materials without express written license from Mploy Jobs.

Job Posters are responsible for all content they upload or post on the Mploy Jobs Platform ("Job Posters' Content"). Job Posters confirm they own all Intellectual Property Rights in their content and agree not to use any third-party intellectual property without authorization. Job Posters indemnify Mploy Jobs against any third-party claims for infringement of Intellectual Property Rights arising from their use of the platform.

Job Posters grant Mploy Jobs a worldwide, irrevocable license to use their content for displaying on the platform, distributing to potential candidates, and storing in a remote database accessible by users, for a charge.

All intellectual property rights on the Mploy Jobs Platform belong to their respective owners. Any issues related to these rights should be addressed directly to the respective parties.



4. Third Party Sites, Services and Products

Links to third-party sites or apps may be provided via the Mploy Jobs Platform. Mploy Jobs doesn't control these sites/apps and isn't responsible for their content. Any transactions or interactions with third parties are solely between the Job Poster and the third party. Mploy Jobs doesn't endorse third-party sites/apps or guarantee the accuracy of third-party content on the platform. Users should review third-party terms before engaging. Mploy Jobs isn't liable for any issues arising from third-party transactions.



5. Participation

All information collected from Job Posters, such as registration (including but not limited to email addresses, mobile phone numbers, government identity documentation), and payment information, is subject to Mploy Jobs' Privacy Policy, available at Privacy Policy. We do not share personal information of any individual with other companies/entities without obtaining permission. We may share all such information that we have in our possession in accordance with our Privacy Policy. Once the personal information has been shared with you, you shall, at all times, be responsible for securing such information. You warrant and represent that you shall not disclose or transfer personal information shared by us to any sub-processors without ensuring adequate and equivalent safeguards to the personal information. You hereby agree and acknowledge that you will use the information shared with you only for the purpose of the Services. You shall not use such information for any personal or other business purposes. In the event you are found to be misusing the information shared with you, we shall, at our sole discretion, delete your account with immediate effect, and you will be blocked from using/accessing the Mploy Jobs Platform in the future.



6. Job Poster Conduct

Job Posters agree to comply with Mploy Jobs' Terms of Service and all other platform rules and regulations. Mploy Jobs reserves the right to take necessary actions if Job Posters violate these terms, including:

- Restricting, suspending, or terminating a Job Poster's access to Mploy Jobs Services.

- Deactivating or deleting a Job Poster's account and related information, with any remaining balance transferred to the Job Poster's bank account, subject to processing fees.

Job Posters must provide accurate information during registration and keep it updated. Each Job Poster should have only one Mploy Jobs account.

Job Posters agree to receive communications from Mploy Jobs and are responsible for maintaining account security. They should not share passwords and must notify Mploy Jobs of any unauthorized account access.

Job Posters must follow the Code of Conduct, including not using cheats, bots, or engaging in disruptive behavior. They should also respect intellectual property rights and refrain from posting false or misleading content.

Using Mploy Jobs for illegal activities or actions that threaten security or public order is prohibited.

Accessing Mploy Jobs via unauthorized means or using automated tools without approval is not allowed.

Mploy Jobs complies with legal requests related to platform usage. Individuals under 18 are not allowed to register, and false declarations may result in loss of account access and indemnification of losses incurred by Mploy Jobs.

Mploy Jobs is not liable for content posted by Job Posters on the platform.



7. Eligibility

The Mploy Jobs Platform is open only to persons above the age of 18 years.

The Mploy Jobs Platform is open only to persons currently residing in India.

Persons who wish to participate must have a valid email address and/or mobile phone number.

Mploy Jobs may, upon receipt of information, bar a person from accessing their Mploy Jobs account if such person is found to be in violation of any part of these Terms of Service or the Code of Conduct.

Only those Job Posters who have successfully registered on the Mploy Jobs Platform shall be eligible to Post Jobs.



8.DISPUTE RESOLUTION AND JURISDICTION

In the event of any dispute between the Parties arising from or related to these Terms, the Parties agree to resolve the dispute through mediation and arbitration.

a) Mediation: The Parties will attempt to resolve any disputes amicably amongst themselves. If a resolution cannot be reached within thirty (30) days of one Party communicating the dispute to the other Party, the dispute will proceed to arbitration.

b) Arbitration: If mediation fails to resolve the dispute, it will be referred to arbitration by a sole arbitrator appointed by the Company. The arbitrator's award will be binding on both Parties. Each Party will bear their own costs for the proceedings, unless otherwise directed by the arbitrator. Arbitration proceedings will be conducted in English, with the seat of arbitration in the city of Chennai.

The Parties agree that these Terms, the Policy, and any other agreements between them are governed by the laws, rules, and regulations of India.



9. Release and Limitations of Liability

Job Posters access Mploy Jobs Services on the Mploy Jobs Platform voluntarily and at their own risk. Mploy Jobs is not liable for any loss or damage incurred during access.

By accessing the platform, Job Posters release and indemnify Mploy Jobs, its directors, employees, and licensors from any liability arising from their use, including personal injury or property damage.

Mploy Jobs accepts no liability for errors or omissions in platform data.

Job Posters are responsible for any consequences resulting from illegal acts or non-compliance with terms. They agree to indemnify Mploy Jobs for any losses incurred.

Job Posters must defend Mploy Jobs from third-party claims related to their platform engagement.

Job Posters waive claims against Mploy Jobs for any injuries or mishaps arising from platform use.



10. Disclaimers

Mploy Jobs, its parent company, subsidiaries, affiliates, directors, officers, and employees are not responsible for the deletion, failure to store, or untimely delivery of any information or material.

Mploy Jobs is not liable for any harm resulting from accessing information or material on its platform, including server quality, products, or services.

Job Posters access material on Mploy Jobs at their own risk and are solely responsible for any potential damage to their computer system or loss of data.

While Mploy Jobs endeavors to ensure the platform is error-free and secure, it does not guarantee that the platform will meet Job Posters' requirements, be uninterrupted, timely, secure, or error-free, or that the material obtained will meet expectations.

Mploy Jobs reserves the right to rectify errors, including deducting erroneous payments from Job Posters' accounts.

Mploy Jobs and its partners, licensors, or associates are not liable for any direct, indirect, incidental, special, or consequential damages arising from platform use.

Any services requiring specific permission from authorities will be canceled if permission is not obtained.

In the event of service suspension or closure, Job Posters are not entitled to any demands or claims.



11. Grievance Redressal Mechanism

If you have any complaints regarding content violations, access issues, or objectionable material on the Mploy Jobs platform, please email us at info@mployjobs.com

In your complaint, include:

- Your name, contact details, and address.

- Your relation to the complaint.

- Details of the grievance with clear identification of the content.

- A statement affirming the accuracy of the information provided.

Mploy Jobs respects intellectual property rights. If you notice copyright infringement on our platform, please email us at info@mployjobs.com with:

- Identification of the copyrighted work.

- Identification of the infringing material.

- Your contact details.

- A statement affirming the unauthorized use of the copyrighted material.

- Your signature or the signature of your authorized agent.

Upon receiving a complaint or notice, Mploy Jobs will investigate and take appropriate action. We may contact you for further clarification or assistance.

12. Paid Services

By subscribing to our paid services, you agree to adhere to additional terms specific to the services you're availing.

Access to Mploy Jobs and posting jobs depends on the paid services you avail. We reserve the right to change or suspend paid services without prior notice.

Refunds, if applicable, will be determined at our discretion and made pro-rata to your usage of paid services.

Paid services include:

- Job Posts

- Where you can post jobs by subscribing to the Job Post Plans.

Each service has specific terms regarding pricing, validity, and usage. We may partner with third parties to provide certain services.

You're responsible for verifying information received through our platform. Refunds are only applicable in certain circumstances, as specified in our terms.

Your subscription plan is non-transferable and subject to Indian laws. Access to paid services is based on your account type: individual or organisational.

For organisational accounts, designated users must be registered and approved by us. We reserve the right to restrict job posts per account.
